Auto and Car Insurance

Car Insurance?

I was involved in a car accident (I am at fault) while I was vacationing in CA. I had a rental car and had declined the insurance. I was counting on my visa card coverage as well as my own insurance policy. My insurance informed me that there is a $6,000 difference between the total damage and my coverage and I may be responsible for that amount if other party does not sign the release form that was sent to them. As of today they did not decline to sign but didn't sign either. Insurance company tells me that they may sign it so that I will not be held responsible. My questions are: 1.what are the chances that they will sign it? If they can come after me to get the difference, why would they just bear the cost and sign the release form? 2. If they come after me do I have to pay the difference before they go to the court? Am I going to be asked to pay the whole amount or there is a room to negotiate? Thanks!

  1. I certainly can't tell you what the injured party will do as far and signing or not signing. Nor can anyone here. What did your credit card company tell you? Did they cover any or all of the accident? I don't know the answer to your second question either. You may want to consult with an attorney regarding this.
  2. 1. They might settle just to get through the process. 2. Negotiate.
