Auto Insurance broker failed to add driver and now claim has been denied Help pleassssse?

So I called the owner of the broker company who told me that he would gladly backdate the policy upon the notion that AIG would accept it and they said that they would. Then the owner called me back stating that his broker that issued the policy already gave a recorded statement to the insurance company stating that he did not remember us requesting the added driver to the policy so he cant help us or he would lose his license as a broker by recanting on a recorded statement so he then told me to make the adjuster take the recorded statement off the record and they will do it but it is illegal to even ask them to do that. Our Policy has canceled several other times due to this broker not turning in the proper paper work to AIG. I need help I have went through all the chain of comands and the california insurance board what is left??

  1. You are in-deed between a rock and hard place. Since you have been to the insurance board you probably have one possible remedy (an appeal to the board not withstanding) left - a civil suit. Talk with a lawyer and explain the case in-depth as well as presenting him any proof of your statements to them. The lawyer will be able to help you determine if that is the route to go and if you have exhausted all routes of remedy. You have been hurt, to what degree I don't know, by the agent's actions. The fact that he has several mistakes concerning your insurance in the past, his offering to commit an illegal act on your behalf as well as his soliciting you to commit a illegal act has to make a person wonder how many other people he has placed in this situation. If AIG is aware of his misdeeds and has done nothing to correct them then they are also a part of the problem. Bottom line - sit down and talk with a lawyer and get good advice on what to do. And, I would be shopping for a new agent and insurance company.
