Auto Insurance broker failed to add driver and now claim has been denied Help pleassssse?

So I called the owner of the broker company who told me that he would gladly backdate the policy upon the notion that AIG would accept it and they said that they would. Then the owner called me back stating that his broker that issued the policy already gave a recorded statement to the insurance company stating that he did not remember us requesting the added driver to the policy so he can't help us or he would lose his license as a broker by recan'ting on a recorded statement so he then told me to make the adjuster take the recorded statement off the record and they will do it but it is illegal to even ask them to do that. Our Policy has canceled several other times due to this broker not turning in the proper paper work to AIG. I need help I have went through all the chain of comands and the california insurance board what is left??

  1. Do you mean back date a police to cover a driver that wasn't on the policy at the time of an accident? That would be insurance fraud. If you had legitimately provided the name and the broker failed to add them that's another matter but you are going to have to prove that happened.
  2. Didn't you sign any paperwork when you took out the insurance? Didn't you read it? Why didn't you know that the driver wasn't on it when it was issued? YOU have some responsibility here, not just the broker you say "failed". You don't have any proof of his failure if you can't produce an application or other evidence that you instructed him to add the driver at the time the policy was issued. And all of this stuff about backdating, but only because you and the owner thought you could get away with it, IS fraud. If AIG knew that the agency had agreed to that, he would lose his license, just as he should. You should probably leave it alone now. If you tell this story too many more times to a few more people, you could wind up charged with fraud and conspiracy. Next time, read the paperwork.
  3. Look at your policy. Whatever it said at the time of the accident is what was in place. You can not "back date" to add another driver nor can you "remove" a sworn statement previously made. I think you are omitting facts. I bet it went something like this. You have a policy where other people can drive your car on occasion. So you let your son or daughter drive thinking they were covered under that provisions. Then they had an accident and you found out they needed to be NAMED on the policy. So you called the owner and told him you had added your child but his broker did not do the paper work. So the owner said he would take care of it, only to find out the adjuster had already talked to the broker and he had already said you did not call to add the kid. So you could not get the owner to ILLEGALLY back date the policy nor could you get the broker to ILLEGALLY deny his sworn statement. So now you are screwed. Not only are you screwed for the damages to the vehicle and what not, your kid can be charged for driving without insurance, which is a big NO NO in California. You tried to save a buck and now you are out a lot of money AND your kid can lose his license for six months to a year. I do not think you will get much help from any source.
  4. WOW! What a question... Unfortunately I don't KNOW much about CALIFORNIA... that LAND that is going to slide into the ocean... That has it's OWN laws... so FAR AHEAD of the rest of the Nation... And, I don't know what you mean by "AIG"... MY problem, with this whole thing, is when you state that the "someone" is going to "backdate"... whatever it is!!! ( You KNOW, don't you, that 'backdating' is NOT exactly LEGAL, don't you!?!?!) I'm not sure I understand the REST!!! Sounds to ME. like "HE" was trying to do YOU a 'favor', but it didn't work! Again, I don't know who AIG is, but, as YOU stated, if your policy has been "canceled several other times due to this broker not turning in the proper paper work to AIG."... Then I have a couple of questions: * How 'many' is a 'couple of times?' * WHY wait a 'couple of times'...??? * CANCELLED??? WHY??? * I don't want to take HIS side, or YOUR side, but was it (whatever it was) EXPLAINED to you? Did you 'sign' anything that said it WAS explained to YOU??? Sounds, to ME, like if all of the above questions get 'answered' the 'right' way... you need to go after the "AGENT" / Broker - whatever - the COMPANY, for employing him as a 'representative'... GOOD LUCK... Unfortunatley, sometimes it costs a TON of $$$ to PROVE that YOU are RIGHT!!! (Don't forget to ask for 'PUNATIVE' damages, so you can PAY your Lawyer! (Also, Make sure that if your Lawyer LOSES your case... HE can't come after YOU for HIS expenses!!!) Might not sound like a real 'rosey' outlook...But... THINK about this... There is ALWAYS ... "YOU"... NO ONE... ('cept ONE) can take THAT away!!! And, when 'HE' takes... there won't BE any 'arguing'... It'll be DONE!!! I wish "I" was your 'lawyer'!!! YOU probably wouldn't have a 'dime'... but I would have so many 'suits' going, that when I got DONE, you would STILL owe me $$$ ??? I don't know! Maybe that's how I should have answered this... I don't KNOW! Hope I have given you something to THINK about!!! :)
  5. You are in-deed between a rock and hard place. Since you have been to the insurance board you probably have one possible remedy (an appeal to the board not withstanding) left - a civil suit. Talk with a lawyer and explain the case in-depth as well as presenting him any proof of your statements to them. The lawyer will be able to help you determine if that is the route to go and if you have exhausted all routes of remedy. You have been hurt, to what degree I don't know, by the agent's actions. The fact that he has several mistakes concerning your insurance in the past, his offering to commit an illegal act on your behalf as well as his soliciting you to commit a illegal act has to make a person wonder how many other people he has placed in this situation. If AIG is aware of his misdeeds and has done nothing to correct them then they are also a part of the problem. Bottom line - sit down and talk with a lawyer and get good advice on what to do.
