Car crash without contact with other vehicle - Liability insurance only?

Someone cut me off yesterday and I crashed my car into the curb and hit a Stop sign. I have liability insurance only. There was no contact with his vehicle but there are significant damages to my car. Nobody was injured. Is the other cars' (that cut me off) insurance company liable to pay for my damages even though there was no contact? The police did not write up a ticket or make a complaint since we had already exchanged insurance information, no one was injured and he (the other driver) agreed that it was his fault and readily gave me his insurance information. Any help on how I should go about claiming damages is appreciated.

  2. call his insurance company and see if he already contacted them. if not, ask them to set up a claim for you. they will contact their insured and get his side of it. if he states he was at fault, they may go ahead with the claim and pay your damages. if he denies it, theres little chance of them paying it. the bad thing the police did not cite anyone or make a report, so you are at a you said he said thing.

That should have been considered wreckless driving, but without witnesses or a citation, tough call. Oral statements can be denied and become one's word against another. No judge will consider trying to determine who is telling the truth and who is not.
  4. You should have been driving so as not to crash if cut off. I know, but that's the way insurance and the law will look at it. You can make the claim with your insurance and give them the other party's information, but I'd bet they won't pay and you won't collect unless you have collision coverage, which you don't. No contact = no fault.

  7. This is almost always an uphill battle. First, the other party will not deny they were at fault. Sorry, this is just what people do. They change their minds when your no longer looking at them face to face. This is _extremely_ sneaky but does your state allow phone recordings when only one person knows about it? If so, can you call this person and have them admit to what happen in the accident? Their adjuster _might_ consider this info if they deny the claim. It's not the greatest way to handle the situation but it might work. Of course, the other party might admit the same information to their insurance company. If the other party confirms that they contributed to the accident then most likely the other carrier will accept only some liability. This is because they can always argue since there was no contact you over reacted, etc. Then, depending on the state laws, you might have tour settlement reduced or negated all together (some state laws are pure contributory, meaning if you contributed to the accident at all, you cannot collect). If the other party denies liability then you may want to report the loss to your insurance company as the city may want to collect for the replacement of the stop sign.
