Car Insurance?

The owner of the vehicle has liability insurance, but the owner was not the person driving the car. The person driving the car was arrested and charged with several counts of aggravated and simple assault as well as endangering the welfare of a minor. The driver of the vehicle is not on the insurance policy. The owner only has liability now what.

  1. If the driver was given permission to use the vehicle by the owner, then the owner's liability coverage will pay for the damage to your vehicle up to the policy limits. If the person did not have permission, they may deny coverage to the owner.
  2. I believe no matter what the owner of the vehicle, the liability insurance. Will have to cover no matter what. When you purchase insurance it is for your car, not you. Personal driver insurance is a totally seperate thing. I had a friend who had an ATV stolen from them and the theif ran over a lady. The lady sued my friend (the owner), and won.
  3. If the owner admits that they gave the driver permission to drive the car, then their insurance will have to cover it, although you may have to fight in court. If he didn't give permission, you'll have to sue the driver. In this case, since he is already going to jail you may be SOL. I'm very sorry, my full coverage insurance has uninsured motorist protection. If you have that, your insurance may pay for it. Small consolation though since your premium will go up.
