Can I sue my insurance company if they do not cover my vehicle that was in an accident? ?

When I purchased the vehicle, the people at the lot made sure that I had full coverage. Now that I have had an accident with the vehicle my insurance provider says that she never added my vehicle to my policy.

  1. Try to resolve this with a supervisor or administrator of the company. Check for any paperwork that shows you have this type of coverage. If their files say it's not insured, and you are 100% POSITIVE that they made a mistake, threaten to sue.
  2. Do you have proof of having submitted money for the premium? (a Post Office receipt?) Do you have proof of their receipt of money for the premium? (a canceled check?) Whether they added the car or not is not the issue. The issue is did you pay the premium? If the premium is paid, they have to cover the policy.
  3. Looks like the seller had a duty to cover you with insurance, if that was part of the purchasing agreement. If she didn't then the responsibility should be there. But you should have have some kinda of agreement/policy proving the sellers duty to include insurance and what type of insurance. You say that there is a policy where did you get it? You really make sure you have insurance before you drive any car! S'pose thats something to learn from if you buy another car, unfortunately ignorance is no defence.
  4. you should contact a lawyer for a free consultation on your rights. get the information from your dealer on the coverage that was in place when you purchased the car. The insurance company usually can decline to add your vehicle. You should have received info from the insurer that it was added within 30 days to your policy.
  5. The seller asked you to show coverage. The did NOT, and without WRITTEN authorization from you CANNOT add the car to your policy. Did YOU contact the insurance company to add the car? If you did not, you have been driving uninsured and have no recourse. If you did, you should have been sent a new 'Declarations' page for your policy that listed the car and a 'proof of insurance' card to keep IN the car.
  6. When you purchase a vehicle from a dealer, the dealer will not let you leave the lot without confirmation that the vehicle is covered by insurance. The insurance company, if you already have coverage on another vehicle that you own or are trading in for the new vehicle, will confirm that they will cover the new vehicle for 30 days. Before that 30 days runs out, YOU have to go to your insurance company to get the new car covered past the 30 days. They'll need the VIN and you will have to pay any difference in premium owed. If you did not go to the insurance company within 30 days, your new car is not covered past day 30. If that's what happened, they aren't liable for any losses on that vehicle, and you have been driving an uninsured vehicle. You could be ticketed for that. If you did go to your insurance company to add the new vehicle, and did pay the premium for the new vehicle, then you need to get an attorney. But if you didn't add the vehicle by talking to the insurance, expect to be sued by the lender (and the other party, if you were at fault.)
